Indian Penal Code,1860  - Section 498-A , Section 323

Cruelty and abetment of suicide - Benefit of doubt - Allegation that deceased committed suicide as she was ill treated and demand of dowry made by appellant - Trial Court held that there is no evidence of cruelty or harassment in connection with demand of dowry and accordingly acquitted him - High Court reversed finding of acquittal on basis of letter written by deceased to her sister-in-law in which deceased has stated that her husband had beaten her and asked her to take divorce - Held the Said letter was not produced during course of investigation and there is nothing on record to establish its authenticity - Order of acquittal should not be reversed - Benefit of doubt given to the appellant.
