Negotiable Instruments (Amendment and Miscellaneous Provisions) Act, 2002 - Amended provision - Retrospective or prospective operation - Provisions of ss. 143 to 147 of Act do not take away any substantive rights of accused - Provisions are not substantive but procedural in nature - Apply to cases that were pending on date provisions came into force.
The Negotiable Instruments Act, 1881 - Section 143 , Section 144 , Section 145 , Section 147
Negotiable Instruments (Amendment and Miscellaneous Provisions) Act, 2002 - Evidence on affidavit - Provisions of ss. 143, 144, 145 and 147 of Act expressly depart from and override provisions of CrPC sections 143 to 147 of Act - Designed to lay down a much simplified procedure for trial of dishonoured cheque cases - Claim of accused that complainant or any of his witnesses whose evidence is given on affidavit must be made to depose in examination-in-chief all over again - A demand for meaningless duplication, apparently aimed at delaying trial - Order accordingly.
