The Code of Civil Procedure, 1908  - Order XXXIX Rule (2) ,  Rule (7)

Disobedience of injunction granted by the Trial Court and for striking off the defence for wilful breach of undertaking given to the Trial Court by the defendants - Another application filed by the appellants for injunction against respondents restraining them from carrying out any further work or damaging the property in question - Respondents filed reply justifying the demolition and also tendered unqualified apology - Trial Court granted the relief prayed for in one application and dismissed the other - High Court set aside the order and remanded the matter - Supreme Court on different occasions and to cut short the litigation, interference with the impugned order of the High Court declined with liberty to the parties to clarify their stand briefly before the Trial Court - Appeal disposed of accordingly.
