The Transfer of Property Act, 1872  - Section 111 , The Code of Civil Procedure, 1908  - Order XX Rule (12)

Suit for eviction of tenant on the ground that lease of tenant had expired - Plaintiffs claimed that they were owners of the suit land - Court ordered eviction of tenant alongwith it Court decided the question of title also - Decree of eviction upheld but order with regard to question of title set aside - Court was not called upon to decide the question of title.

The Transfer of Property Act, 1872  - Section 111

Title - Tenants challenging the title of landlord - Tenants will have to surrender possession to the landlords before they can challenge the title of landlords.
