Para Seenaiah Vs. State Of A.P.

Head Note

Indian Penal Code,1860  - Section 147 , Section 148 , Section 324 , Section 307 , Section 341 , Section 149

Trial Court acquitted all the accused - The appellate Court, however, convicted A-1, A-2 and A-4 for the offence punishable under section 326 Indian Penal Code - High Court affirmed and set aside the conviction of the Accused No. 1 under Section 326 and instead convicted him for an offence punishable under Section 324 Indian Penal Code - No reason to interfere with the findings recorded by the High Court, as to the genesis of the incident and the person responsible for the same - There was ample medical evidence to support the prosecution case that the deceased had sustained injuries - It is immaterial that the same had not been proved to be the real cause of his death a week later - Appeals dismissed.
