Government Grants Act, 1895 - Section 3 - Resumption of leased land by Government for public purpose in terms of clause contained in lease deed and recovery of possession of property - Procedure provided under the lease deed, being special procedure, must be followed - Under lease deed, Government was entitled to give notice to resume the demised premises and within two months of receipt of notice, take possession thereof subject to condition that if Government is entitled to give one month's notice in writing to lessee to remove any building standing on demised premises and within two months of receipt of notice, take possession thereof, subject to condition that if government was willing to purchase the building, it has to pay lessee cost of such building, Government must take possession in accordance with the procedure under the lease deed and it cannot be directed to take possession according to procedure prescribed by any other law.
Government Grants Act, 1895 - Sections 3 and 2 - Government grant of lease of land - Such a lease is governed entirely by terms of grant - Government has absolute discretion to incorporate such condition, limitations or restrictions under the terms of grant as it considers fit which will be are binding on the parties.
