Motor Vehicles Act,1988  - Section 188

Compensation - Whether the amount be invested in fixed deposit or disbursed to claimants - Guidelines in AIR 1994 SC 1631 elaborately explained - Compensation awarded to wife and two daughters of deceased, but a part of amount of compensation was ordered be kept in fixed deposit - Mother and daughters highly educated and well versed in managing their lives and finances - Order of Tribunal set aside - Held - In the case of literate persons, it is not mandatory to invest the amount of compensation in long term fixed deposit - Further Held - Guidelines issued by Supreme Court in the case AIR 1994 SC 1632 do not stipulate that in every case the amount of compensation should be invested in long term fixed deposit and under no circumstances the Tribunal can release the entire amount of compensation to the claimant even if it is required by him.
