Motor Vehicles Act,1988  - Section 168 , Section 173

Quantum of Compensation - Income of deceased - Determination of - Deceased working as a Tool and Die Engineer in a Malaysian Company - Appellant failed to prove his income with documentary evidence - Fact that deceased was holding an engineering certificate and was working in Malaysia not disputed - In view of such undisputed fact as to his qualification particularly about working in overseas company, it would be just and reasonable to consider his monthly income as Rs. 8000/- instead of Rs. 500/- p.m. affixed by High Court - Compensation recomputed accordingly - Compensation of Rs. 7,90,000/- awarded.
