ILC-2015-SC-CIVIL-Aug-11

Ghudusab & Ors. Vs. Ghudusab Immamsab Burdi (D) By Lrs. & Ors.

Head Note

The Code of Civil Procedure, 1908  - Section 100

Second Appeal - While deciding Regular Second Appeal the High Court had not considered the judgment delivered by the Apex Court in the case of Abubkar Abdul Inamdar (D) by LRs. & Ors. Vs. Harun Abdul Inamdar & Ors. [(1995) 5 SCC 612], which prima facie appears to be quite relevant - Appeal remitted to the High Court so that after considering the aforestated judgment and other relevant judgments, which might be referred to by the learned counsel for the parties, the appeal can be decided afresh.

Topic(s)-Civil Procedure - Second Appeal - Remand back
