Conviction - Sentence - Reduction in Sentence - Sessions Court while setting aside the conviction of the accused under section 326 IPC upholding conviction under section 323 IPC sentenced respondent to imprisonment of one and half years with fine of Rs.1000/- - High Court has taken lenient stand - By noting that the respondent had been in jail for 4 months with remission of 15 days and that the incident took place on 30.10.2023 resulting in a trial for 9 years and modified the sentence to the period already undergone subject to payment of R. 20,000/- to the complainant - Impugned order passed by the High Court liable to be set aside -The matter remanded back to the High Court.
