Murder - Common Object - Appeal against conviction - Unlawful assembly - Common object - In Criminal Appeal filed by coaccused of appellant it was found that the shot was fired by 'P' - Role of the appellant and that of the coaccuse 'D', both of whom were armed with lathies, is similar- As such, the case of the present appellant is identical to the case of 'D' Kishan, already decided by the Apex Court - In the light of decision in the appeal of co-accused 'D', conviction and sentence of the appellant recorded by the trial court in respect of offence punishable under Section 302 read with Section 149 IPC liable to be set aside - His conviction and sentence in respect of other offences punishable under Section 148 IPC, and under Sections 307 and 323 both read with Section 149 IPC liable to be affirmed.
