The Land Acquisition Act, 1894  - Acquisition of Lands

Land Acquisition - Compensation - The appellant shall be entitled to the benefits as per the law laid down in K.S. Paripoornan (II). It is not disputed at the Bar that the appellants are not entitled to the benefits under Section 23(1A) in view of the decision in K.S. Paripoornan (I) vs. State of Kerala [(1994) 5 SCC 593] - The person entitled to the compensation awarded is also entitled to get interest on the aggregate amount including solatium - The respondent while computing the amount shall take the same into consideration. Needless to say, in case the respondents do not comply with the judgment, execution can be levied and at that juncture this aspect can also be taken note of as it forms a part of the decree - the appellants shall be entitled to the benefits as stated.
