Claim of parity - All five accused convicted for 3½ years RI with fine - Sentence enhanced to 5 years RI by High Court - Three co-accused released on probation of good conduct for the term of imprisonment - Claim for Parity by remaining two accused - Incident 19 years old - Held, claim is misconceived - Three co-accused were given benefit due to their old age. Sentence was enhanced because of the sole grievous injury suffered by victim - Had the prosecution witnesses named the accused responsible for it, court would have given higher punishment to him. However, on facts and circumstances, sentence reduced to 3 years RI.
