Exclusion of time in certain cases - CPC, 1908 - Section 80 - The appellants filed suit for payment of balance money - The High Court noted that the notice was served on defendant No.1 but dismissed the suit as barred by limitation - The Supreme Court held that just because the appellants gave the notice before the expiry of the period of limitation, the benefit which is given under Section 15(2) of the Act cannot be taken away, therefore, that in computing the period of limitation, the period of notice, provide notice is given within the limitation period, would be mandatorily excluded - Appeal allowed - No costs.
