Accident caused due to rash and negligent driving of tempo by its driver - Claimant suffered serious injuries and had to spend more than Rs.80,000/- towards medical treatment, conveyance and expenses of the attendants - Claimant is student of Class 8 and on account of the injuries he was not in a position to continue his studies - Owner and driver did not contest - National Insurance Company contested - Tribunal held that accident was caused due to rash and negligent driving of the tempo and awarded compensation Rs. 1,49,440/- - Appeal by claimant and High Court partly allowed the appeal and enhanced amount of compensation by a sum of Rs.40,000/- Aggrieved claimant filled appeal- Supreme Court- Record shows appellant had produced substantive evidence - Held - Ends of justice will be met if appellant is awarded a sum of Rs.2 lacs which, if deposited in a fixed deposit, would earn an interest of Rs.14,000/- to 16,000/- per annum - Judgment modified that appellant entitled to total compensation of Rs.6 lacs with interest at rate of 6% per annum from the date of filing claim petition - Appeal allowed.
