Constitution of India, Article 136 - Motor Vehicles - Special Leave Appeal - Third party risk - Decree passed in favour of third party - Plea raised that in view of finding of Tribunal that driver of the insured was not holding a driving licence and particularly when he happened to be the owner of the vehicle no liability can be foisted on the insurer, held not maintainable - However, the Insurance Company would be entitled to realise the amount of compensation as assessed from the owner/driver of the offending vehicle.
