Motor Vehicles Act,1988 - Section 149 (2)
Motor accident - Driving licence - Liability of insurance company - Insurance company disputed - Licence was only for light motor vehicle and goods vehicle - No evidence however produced by insurance company to prove that accident caused due to negligence of driver - Further nothing to show that cause of accident disqualifies driver to drive passenger vehicle - No proof that owner was negligent and failed to exercise reasonable care in fulfilling conditions of policy before giving vehicle to the driver - Insurance Company held liable to pay compensation.
